    HEARING OFFICER ORDER
    On June 9, 2009, the parties participated in a telephone status conference with the hearing
    officer. The parties hope to resolve the final compliance issues by having the consultant submit
    a construction permit application.
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 9:30 a.m. on July 21, 2009. The telephone status conference will be initiated by the
    petitioner.
    Petitioner filed an open waiver of the statutory decision deadline in this case.
