HEARING OFFICER ORDER
On August 7, 2008, all parties participated in a telephonic status conference with the
hearing officer. The petitioner represented that it is still reviewing a draft permit application that
was forwarded by the respondent and that further discussions will be held with technical
personne from the respective parties. To that end, the record is now due to be filed on or before
August 29, 2008. The petitioner represented that it will file an additional waiver of the statutory
decision deadline to and including November 20, 2008.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on August 21, 2008, at 9:15 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
