NARRATIVE

On November 3, 2000 I received a phone call from Harold Alexander, Jr1~ingik~IkPC
Prior Oil Company had excavated a trench on their property at the end ofMitchell Street,
behind the Prior Oil Company buildings on November 2, 2000. He went on to say that oil
spill cleanup debris had been dumped into the trench and subsequently set on fire. He
said that the waste was presently burning and emitting smoke. Shortly thereafter, also on
November 3, I received a phone, call from Greg Earle who is the Fire Chief ofthe
CentraliaFire Protection District. He also informed me that some oil spill cleanup debris
had been dumped on Prior Oil Company property and was currently burning. He said that
his personnel and equipment were, presently at the site. I told him that we would be there
shortly to investigate and monitor the situation.
On November 3, 2000 at 11:25 am, Mike Grant-BOL, JeffBenbenek-BOA and I arrived

at the site where, we met up with Mr.. Earle at the dumping and burning area. I observed a
• recently excavated trench approximately 8 ft. by 30’ft. by4 ft. deep with crude oil soaked
straw and black plastic bags in it. The oil and straw were smoldering, emitting white to
grayish smoke. No open flames were seen. A 10 ft. by 10 ft. area of oil and straw waste
was also observedjust north of the pit. Mike Grant took 8 digital photos ofthe relevant
site conditions. Harold Alexander, Jr. told me at the site that the trench had not been dug
as of9:00 am on November 2. After inspecting the site and speaking with Mr. Earle and
Mr. Alexander, we walked to the office in order to contact John Prior. He was in his
office and I proceeded to question Mr. Prior after he was introduced to Mr. Grant and Mr.
Benbenek. I told him that we had just been back at the area where a trench had been dug
and oil soaked straw was burning. He readily admitted that he. was responsible for the
situation and gave the following explanation. He said that he made a decision to clean out

one ofhis buildings adjacent to the dumping and burning areaon November 2. During
the cleaning process some of his employees took the oil and straw waste from inside the
building and placed it outside ‘on the ground. Mr. Prior said that when he found out what
his employees had done, he was concerned about oily water running offof.the property
‘
due to impending rain. H~said it was at this point that he directed that a trench be dug
and that the waste be placed into it and subsequently burned. Mr. Prior indicated to us
that he felt that the dumping and burning was a better solution to the waste‘material being
outside, than possibly allowing oily water runoff. It did in fact rain during the afternoon
ofNovember 2. Mr. Prior realized,that what he directed be done was a violation of
environmental law, and rules. At the conclusion ofthe site visit and interview, I told Mr.

‘Prior and Mr. Earle that the smoldering waste needed to be extinguished immediately. It
was decided that the material would be smothered out and later disposed ofproperly at a
permitted landfill. We departed the site at 12:00 noon.
