HEARING OFFICER ORDER

On November 30, 2006, a telephonic status conference was held. The respondent the

Highlands, L.L.C. (Highlands), did not appear due to a scheduling conflict. The complainant

represented that a stipulation and proposal for settlement (stipulation) as to Highlands is being

circulated for signatures. The parties present represented that a revised stipulation regarding

Murphy Farms, Inc., is being circulated for review and comment.

The parties are directed to participate in a telephonic status conference with the hearing

officer on February 1, 2007, at 10:30 a.m. The status conference must be initiated by the

complainant, but each party is nonetheless responsible for its own appearance. At the status

conference, the parties must be prepared to discuss the status of the above-captioned matter and

their readiness for hearing.
