HEARING OFFICER ORDER
On May 21, 2009, all parties participated in a telephonic status conference.
Discussions centered on the affirmative defenses filed by the respondent on May 8, 2009.
Complainants requested that a short discovery schedule be implemented regarding
respondent’s first affirmative defense. The respondent objected and requested that
complainants file a pleading addressing the affirmative defense. Complainants request
was denied. The complainants represented that they will file a motion to strike the
affirmative defenses on or before June 5, 2009. The respondent was directed to file its
response on or before June 26, 2009.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on July 23, 2009, at 11:00 a.m. The telephonic
conference must be initiated by the complainants, but each party is nonetheless
responsible for its own appearance. At the conference the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing.
