HEARING OFFICER ORDER
On May 18, 2009, the parties participated in a telephone status conference with
the hearing officer. The parties are waiting for the Board’s ruling on petitioner’s motion
for summary judgment. If the Board hasn’t ruled on the motion by the next status
conference, petitioner will need to decide whether to file an additional deadline waiver,
or set the case for hearing.
The parties are directed to participate in a telephone status conference with the
hearing officer at 10:30 a.m. on June 22, 2009. The status conference shall be initiated
by the petitioner.
The decision deadline is currently September 17, 2009.
