HEARING OFFICER ORDER
On October 28, 2004, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that settlement discussions have been ongoing and that
the Illinois Environmental Protection Agency (Agency) recently reviewed a supplemental
environmental proposal (SEP) and rejected it. The Agency did include possible alternative
SEP’s that the respondent will review and discuss internally. The respondent made an oral
motion for an extension of time to file its answer. The complainant had no objection.
Respondent’s motion is granted. Respondent’s answer is now due to be filed on or before
January 10, 2005.
The parties or their legal representatives are directed to appear at a telephonic status
conference with the hearing officer on December 21, 2004, at 9:15 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the conference the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing.
