HEARING OFFICER ORDER
On October 19, 2004, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that they have reached a settlement in this matter subject
to final approval. The petitioner made an oral motion for an extension of time to file a response
to the respondent’s motions for reconsideration and to dismiss if needed. The respondent had no
objection. The petitioner’s motion is granted and its response is now due to be filed on or before
April 13, 2005. The respondent made an oral motion for an extension of time to file the record
in the above-captioned matter if needed. Petitioner had no objection. The respondent’s motion
is granted and the record is now due to filed on or before April 13, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on January 21, 2005, at 10:00 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing. If, however, a motion to voluntarily
dismiss is filed prior to the next status conference, the conference will be cancelled without
further order.
