HEARING OFFICER ORDER
On January 20, 2005, all parties participated in a telephonic status conference with the
hearing officer. The petitioner represented that the respondent is still reviewing the draft budget.
The respondent anticipates that the draft budget will be reviewed on or before February 23,
2005. If approved, the petitioner anticipates that it will file a motion to voluntarily dismiss this
matter. Petitioner represented that it will file a 60-day waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on March 10, 2005, at 10:45 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing. If, however, a motion to voluntarily
dismiss is filed prior to the next status conference, the conference will be cancelled without
further order.
