HEARING OFFICER ORDER
On October 5, 2004, the parties participated in a telephone status conference with the
hearing officer. Respondent is still deciding whether it will issue the permit to petitioners based
on the Board’s ruling, or whether it will take steps necessary to appeal the Board’s decision in
circuit court. Respondent expects to reach a decision by the next status conference. At that time,
petitioner should be prepared to waive the decision deadline or set this matter for hearing.
The parties are directed to participate in a telephone status conference with the hearing
officer at 10:30 a.m. on October 29, 2004. The telephone status conference will be initiated by
the petitioner
The statutory decision deadline is currently February 28, 2005.
