NOW COMES the Respondent, the Illinois Environmental Protection Agency (“Illinois
EPA”), by one of its attorneys, John J. Kim, Assistant Counsel and Special Assistant Attorney
General, and, pursuant to Section 40(a)(1) of the Illinois Environmental Protection Act (415
ILCS
5/40(a)(1))
and 35 Ill. Adm. Code 105.208, hereby requests that the Jllinois Pollution
Control Board (“Board”) grant an extension ofthe thirty-five

hearing to June 3, 2004, or any other date not more than a total ofone hundred twenty-five

days from the date of the Illinois EPA’s final decision. In support thereof, the Illinois EPA
respectfully states as follows:

On January 29, 2004, the Illinois EPA issued a final decision to the Petitioner.

On March 3, 2004, the Petitioner made a written request to the Illinois EPA for an
extension oftime by which to file a petition for review, asking the Illinois EPA join in requesting
that the Board extend the thirty-five day period for filing a petition to ninety days. The Petitioner
has subsequently confirmed that the final decision was reôeived no earlier than January 30,
2004.. (Exhibit B)

The additional time requested by the parties may eliminate the need for a hearing
in this matter or, in the alternative, allow the parties to identify issues and limit the scope of any
hearing that may be necessary to resolve this matter.
WHEREFORE, for the reasons stated above, the parties request that the Board, in the
interest of administrative and judicial economy, grant this request for a ninety-day extension of
the thirty-five day period for petitioning for a hearing.

The Illinois EPA has reviewed the activities to be completed as part ofthe plan and made the
above overall cut so that the approved amount of personnel costs is reasonable for the tasks
involved. It was determined that the total amount approved for personnel costs should be
sufficient to accomplish the tasks involved. While the number ofhours or type ofpersonnel
expected to complete the proposed activities is not specified, a reasonable total amount is
specified. Flow a consultant chooses to use this amount (type ofpersonnel used and number of
hours) is discretionary so long as the approved total amount is not exceeded and the personnel
hourly x~ai.~esarc reasonable.

Appeal Rights
An underground storage tank owner or operator may appeal this final decision to the Illinois
Pollution Control Board pursuant to Sections 40 and
57.7(c)(4)(D)
ofthe Act by filing a petition
for a hearing within 35 days after the date ofissuance ofthe final decision. However, the 35-day
period may be extended for a period oftime not to exceed 90 days by written notice from the
owner or operator and the Illinois EPA within the initial 35-day appeal period. Ifthe owner or
operator wishes to receive a 90-day extension, a written request that includes a statement ofthe
date the final decision-was received, along with a copy of this decision, must be sent to the
Illinois EPA as soon as possible.

This letter is a specific request for reconsideration of the budget reductions enumerated in your
October 10, 2003 letter.
Our concerns center on the ‘$5,118.00 for excessive personnel costs’, reduction. We feel that the
costs set forth in the original budget, submitted on September 19, 2003, are appropriate to
adequately undertake the plan as approved by your office.
Our office has made repeated attempts to contact you regarding questions we have, relative to the
approved Site Investigation Plan and Budget, referenced above. We consider the budget
reductions to the personnel costs, to be significant and unwarranted. We question, where, in
particular, these reductions have been made. We take great care in the preparation of our budget
proposals and are confident that they represent a reasonable cost to carry out the work effort as
described in the Site Investigation Plan.

Board (IPCB). This request is being made to preserve Casey’s right to appeal the Agency

The additional time is needed for American Environmental to submit information and a request
