    ORDER OF THE BOARD (by J.P. Novak):
    On December 12, 2003, the Office of the Attorney General, on behalf of the People of the
    State of Illinois (People), filed a complaint against Hauck Homes, Inc. (Hauck Homes) d/b/a
    Rock River Estates Mobile Home Park.

    415 ILCS 5/31(c)(1) (2002); 35 Ill. Adm. Code
    103.204. The People allege that Hauck Homes violated Section 12(a) and (f) of the
    Environmental Protection Act (415 ILCS 5/(a) and (f) (2002)); 35 Ill. Adm. Code 304.121(a),
    304.141(a), 305.102(a) and 306.102(a); and conditions of National Pollutant Discharge
    Elimination Permit (NPDES) permit IL0052582. The People further allege that Hauck Homes
    violated these provisions in the operation of the site’s wastewater treatment plant by causing,
    threatening, or allowing water pollution of the Rock River through violation of the fecal coliform
    effluent standard and by failing to fulfill various operational requirements set forth by permit.
    The complaint concerns Hauck Homes’ Rock River Estates Mobile Home Park in the southeast
    quarter of Section 9, Township 21 North, Range 8 East of the Fourth Principal Meridian in
    Nelson Township, Lee County.
    The Board accepts the complaint for hearing.

    respondent’s failure to file an answer to a complaint within 60 days after receiving the complaint
    may have severe consequences. Generally, if Hauck Homes fails within that timeframe to file an
    answer specifically denying, or asserting insufficient knowledge to form a belief of, a material
    allegation in the complaint, the Board will consider Hauck Homes to have admitted the
    allegation. 35 Ill. Adm. Code 103.204(d). The Board directs the hearing officer to proceed
    expeditiously to hearing.
