HEARING OFFICER ORDER
On January 10, 2006, the parties participated in a telephone status conference with
the hearing officer. The parties report that this appeal cannot proceed without the
resolution of a related docket, People v. Saint-Gobain Containers, Inc., PCB 03-22. On
December 15, 2005, the Board granted the People’s motion to stay that proceeding until
such time as the Board orders otherwise. While the federal action continues to move
forward, a resolution is not likely in the near future.
If the parties have not moved to withdraw the stay on the People’s case by
December 31, 2006, the hearing officer will direct the parties to submit a status report in
the enforcement case and in this permit appeal.
Petitioner filed an open waiver of the decision deadline in this matter.
IT IS SO ORDERED.
