HEARING OFFICER ORDER
On March 7, 2005, the parties made an oral motion to suspend the briefing schedule. At
the hearing on November 22, 2004, respondent argued that he did not have access to the site.
Since the hearing, respondent has gained access. The parties now agree that respondent shall
have until July 31, 2005 to clean the site. If this is accomplished, complainant will file a motion
to withdraw the administrative citation. If respondent does not meet this deadline, complainant
will file a proposed stipulation wherein respondent agrees to pay the fine.
In light of these developments, the motion to suspend the briefing schedule is granted. If
the parties cannot resolve this matter as anticipated, the hearing officer will reinstate the briefing
schedule.
