    ORDER OF THE BOARD (by T.E. Johnson):
    On July 22, 2008, the Appellate Court, Fifth District, issued a decision vacating the
    Board’s final order in this proceeding and remanding the cause to the Board for further review
    using the correct standard of review. On September 8, 2008, the Board received the court’s
    September 5, 2008 mandate.
    Consequently, the Board directs that the hearing officer schedule a telephone status
    conference with the parties to set deadlines for the filing of legal briefs. Consistent with the
    court’s decision, the briefs must address whether the Illinois Environmental Protection Agency
    abused its discretion in deciding not to hold a public hearing concerning the National Pollutant
    Discharge Elimination System (NPDES) permit for United States Steel Corporation’s Granite
    City steelmaking facility.
