AMENDED HEARING OFFICER ORDER
On October 18, 2007, a telephonic status conference was held with the hearing
officer. The petitioner represented that it was directed to serve its discovery responses to
the respondent on or before October 2, 2007. It was unable to serve its responses by that
date and made an oral motion for an extension of time to file its responses, to and
including October 29, 2007. The petitioner also represented that it will file a waiver of
the statutory decision deadline, to and including May 1, 2008. Over the objection of the
respondent, petitioner’s motion was granted.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on November 15, 2007, 11:30 a.m. The
telephonic conference must be initiated by the petitioner, but each party is nonetheless
responsible for its own appearance. The petitioner represented that the conference call-in
number will be the same as on October 18, 2007. At the conference the parties must be
prepared to discuss the status of the above-captioned matter and their readiness for
hearing.
