HEARING OFFICER ORDER
On December 2, 2008, petitioner participated in a telephone status conference
with the hearing officer. Respondent did not appear. Petitioner’s attorney is retiring at
the end of the month, and a new attorney will appear at the next status conference.
Petitioner is deciding how to proceed in light of the Board’s final ruling in PCB 07-147,
which involved the same site and parties.
The parties are directed to participate in a telephone status conference with the
hearing officer at 1:30 p.m. on January 13, 2009. The status conference shall be initiated
by the petitioner.
Petitioner has filed an open waiver of the decision deadline.
