HEARING OFFICER ORDER
On May 22, 2007, all parties participated in a telephonic status conference with
the hearing officer. The parties represented that they are awaiting the Board’s decision
on complainant’s motion to strike respondent’s affirmative defenses. The parties also
agreed to a revision of the discovery schedule. To that end, the revised discovery
schedule is as follows.
Depositions of lay or fact witnesses must be completed on or before October 4,
2007. Requests to admit must be served on or before November 2, 2007. Requests for
disclosure of expert witnesses must be served on or before November 2, 2007. Written
expert witness disclosures must be served on or before December 3, 2007. Depositions
of expert witnesses must be completed on or before February 4, 2008. All dispositive
and pre-hearing motions must be filed on or before April 13, 2008.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on June 21, 2007, at 11:45 a.m. The telephonic
status conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the status conference, the parties must be
prepared to discuss the status of the above-captioned matter and their readiness for
hearing.
