    ORDER OF THE BOARD (by T.E. Johnson):
    On October 28, 2005, C&F Packing Company, Inc., an Illinois Corporation (C&F) filed a
    petition for a variance for its manufacturing facility located at 515 Park Avenue, Lake Villa,
    Lake County. C&F seeks relief from 35 Ill. Adm. Code 309.222(b) to the extent that it provides
    the owner of an intermediate receiving sewer certify on a permit application that adequate
    capacity is available to transport the discharge proposed by the permit applicant. The Board
    accepted the petition for hearing on September 21, 2006.
    On February 21, 2007, C&F filed an unopposed motion to voluntarily dismiss the
    variance petition. In the motion, C&F asserts that it has reached a settlement agreement with
    Lake County, the Village of Lake Villa, and the Village of Fox Lake that renders the pursuit of a
    variance unnecessary. Mot. at 1. C&F asserts that the respondents do not oppose the motion.

    . The motion is granted. The Board hereby dismisses the petition, and closes the docket.
