HEARING OFFICER ORDER
On November 2, 2006, a telephonic status conference was held. The petitioner
represented that the parties now have an agreed settlement document and that a permit
application has recently been forwarded to the Illinois Environmental Protection Agency
for review. All parties appear to be optimistic that it will be approved. Once approved ,
the petitioner represented that it will file a motion to voluntarily dismiss the above-
captioned matter.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on January 11, 2007, at 11:00 a.m. The
telephonic status conference must be initiated by the petitioner, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties
must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing. If, however, a motion to voluntarily dismiss is filed prior to the next status
conference, the conference will be cancelled without further notice.
