HEARING OFFICER ORDER
On January 11, 2007, a telephonic status conference was held. The petitioner represented
that the parties now have an agreed settlement document and that a permit application has been
forwarded to the Illinois Environmental Protection Agency (Agency) for review. All parties
appear to be optimistic that it will be approved. The Agency represented that the review should
be completed within the next 10 days. The petitioner represented that it will file a motion to
voluntarily dismiss the above-captioned matter when it is approved.
Respondent Lake County represented that it may file a motion to dismiss as moot after
the next telephonic status conference in light of the settlement between it and petitioner in the
event that a motion to voluntarily dismiss is not filed by the petitioner.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on February 1, 2007, at 11:15 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing. If, however, a motion to voluntarily
dismiss is filed prior to the next status conference, the conference will be cancelled without
further notice.
