JURISDICTION
This Administrative Citation is issued pursuant to authority vested in the Illinois
Environmental Protection Agency by 415 ILCS 5/1
et. seq . (2005), specifically 415 ILCS 5/31 .1 .
FACTS
1 .
The Respondent, Francis Case, is the present operator of a facility located in
the County of Ogle, State of Illinois .
2.
The facility is an open dump, operating without an Illinois Environmental
Protection Agency Operating Permit, and designated with the Site Code
#1418205009 . The facility is known to the Agency as Case, Francis .
3 .
That respondent, Francis Case, has occupied and/or operated the facility at all
relevant times hereto.
4.
That on May 1, 2006, Joy K
. Bliton, Field Inspector, Ogle County Solid Waste
Management Department, inspected the facility . Violations noted included 415

 
ILCS 9(a), 9(c), 21(a), 21(d), 21(p)(1), 21(p)(3), 55(a)(1), 55(a)(2), and 35 IAC
812.101(a) .
VIOLATIONS
On the basis of Field Inspector, Joy K . Bliton's direct observation, she has determined
that the Respondent has caused or allowed open dumping at the above described facility in a
manner that resulted in the following violations
:
1 .
The Respondent has caused or allowed littering at the facility in violation of
415 ILCS 5/21(p)(1).
2.
The Respondent has caused or allowed the open dumping of waste that resulted
in open burning in violation of 415 ILCS 5/21(p)(3)
.
CIVIL PENALTY
In accordance with 415 ILCS 5/42
(b)(4), the Respondent is subject to a civil penalty of
$1,500.00
for each violation specified above . This is a total of $3,000
.00 for this Citation .
Additionally, should the Respondent elect to petition the Illinois Pollution Control Board under
the review process described below, after an adjudicatory hearing, the Respondent shall be
assessed the hearing costs incurred by the Pollution Control Board
. The hearing cost would be in
addition to the fine .
If you acknowledge the violations cited herein above, the civil penalty shall be due and
payable no later than 35 days from the date of service hereof.
If you do not petition the Pollution
Control Board for review of the Administrative Citation within 35 days of service of the

 
Administrative Citation, or contest the Citation, any judgment that may be rendered against you
shall specify the due date of the civil fine and any additional costs assessed against you .
When payment is made, your check should be made payable to the Ogle County Solid
Waste Fund and mailed to the attention of John Coffman, Ogle County Treasurer, P .O. Box 40,
Ogle County Courthouse, Oregon, Illinois, 61061 . Also, please complete and return the enclosed
remittance form, along with your payment, to assure proper credit
.
If any civil penalty is not paid within the prescribed time, the law allows for the
accumulation and payment of interest on the remaining unpaid balance. If any civil penalty is
not paid when due, the Office of the State's Attorney shall be requested to initiate proceedings in
Circuit Court to collect the penalty
. In addition to the civil penalty, hearing costs, and interest, if
any, the Ogle County State's Attorney may seek to recover their costs of litigation .

You have the right to contest this Citation, pursuant to 415 ILCS 5/31 .1 . If you elect to
contest this Citation, you must file a Petition For Review with the Clerk of the Illinois Pollution

:18 a .m ., Affiant conducted an inspection of the open dump
operated without an Agency permit, located in Ogle County, Illinois and known as Case,
Francis, by
the Illinois Environmental Protection Agency, Site No

Affiant inspected said Case, Fisher open dump site by an on-site inspection which included
walking
and photographing the site .

As a result of the activities referred to in Paragraph 3 above, Affiant completed the

General Remarks
I could see dark smoke from IL Rt. #2 while on my way to work
. I drove over to where I thought
the smoke was coming from. I found the fire at 9:50 a.m. at 317 E
. Oakwood Drive in Rockvale
Terrace, Byron . Standing by the fire was Luke Case
. He said he was helping his father clean-up
a few things . He was burning about 5 tires on rims, a propane tank, a wooden door, insulation
and an aluminum freezer. Luke Case said that it is his parent's stuff and he was just helping out
.
He called to his father, Francis Case, who came and said he has a business, "Case'y Trucking &
Recycling ." He picks up scrap metal. He said he picks up appliances but tells his customers that
the lines must be cut to show that the Freon has been removed. He also said he knows he
shouldn't bum tires, but they caught on fire while he was doing some torching
. He said a couple
years ago he burned the wood from a horse trailer when the county told him he had to get rid of
it. Other than that, he said he hasn't burned anything .
I advised him this may result in an Administrative Citation (AC) with three violations and that
each violation was $1500 . I said the total fine may be $4500
. I said that he would have an
opportunity to appeal the AC to the Illinois Pollution Control Board, but he must do that within
35 days of receiving the AC. I told him the AC would be sent to him in about a month
.
I gave him the flyers

Waste and Demolition of Buildings and Proper Disposal of Demo Waste
. He said he understood
and didn't have any questions. I left the site at 10
:18 a.m.

large appliances) to a facility that can
legitimately accept them for recycling
. White goods cannot be taken to a landfill or
transfer station for the purpose of disposal
