NOW COMES the Respondent, the Illinois Environmental Protection Agency (“Illinois
EPA”), by one of its attorneys, John J. Kim, Assistant Counsel and Special Assistant Attorney
General, and, pursuant to Section 40(a)(1) of the Illinois Environmental Protection Act (415
ILCS 5/40(a)(1)) and 35 Ill. Adm. Code 105.208, hereby requests that the Illinois Pollution
Control Board (“Board”) grant an extension ofthe thirty-five

On March 31, 2005, the Illinois EPA issued a final decision to the Petitioner.

the Petitioner made a written request to theIllinois EPA for an
extension oftime by which to file a petition for review, asking the Illinois EPA join in requesting.

The additional time requested by the parties may eliminate the need for a hearing
in this matter or, in the alternative, allow the parties to identify issues and limit the scope ofany
hearing that maybe necessary to resolve this matter.

Pursuant to 35 Iii. Adm. Code 732.411(b), in conducting best efforts to obtain off-site
access, an owner or operator must, at a minimum, send a letter by certified mail to the
owr~erofany off-site property to which access is required, stating:
a.
Citation to Section 57 ofthe Act stating the legal responsibility ofthe owner or
operatorto remediate the contamination caused by the release;
b.
That, if the property owner denies access to the owner or operator, the owner or
operator may seek to gain entry by a court order pursuant to Section 22.2c ofthe
Act;
c.
That, in performing.the requested investigation, the owner or operator will work
so as to minimize any disruption on the property, will maintain, or its consultant
will maintain, appropriate insurance and will repair any damage caused by the
investigation;
d.
If

6ntamination results from a release by the owner or operator, the owner or
operator will conduct all associated remediation at its own expense;

site property involved by address, the measures proposed in the corrective action
plan that require off-site access, and the efforts taken to obtain access, and stating
that the owner or operator has been unable to obtain access despite the use of best
efforts; and

A copy ofthe certified letter sent to the owner ofthe off-site property pursuant to
35 Ill. Adm. Code 732.411(b).

Appeal Rights
An underground storage. tank owner or operator may appeal this final decision to the Illinois
Pollution Control Board pursuant to Sections 40 and
57.7(c)(4)(D)
ofthe Act by filing a petition
for a hearing within 35 days after the date.ofissuance ofthe final decision. However, the 35-day
period may be extended for a period oftime not to exceed 90 days by written notice from the
owner or operator and the Illinois EPA within the initial 35-day appeal period. If the owner or
operator wishes to receive a 90-day extension, a written request that includes a statement ofthe
date the final decision was received, along with a copy ofthis decision, must be sent to the
Illinois EPA as soon as possible.
