ORDER OF THE BOARD (by T.E. Johnson):
On April 22, 2005, Midwest Petroleum Company (Midwest) filed a petition asking the
Board to review a March 14, 2005 determination of the Illinois Environmental Protection
Agency (Agency). At issue is the Agency’s failure to consider Midwest’s amended budget for
leaking underground petroleum storage tank facility at 529 Maple Street, Shiloh, St. Clair
    County.
On October 11, 2005, Midwest filed a motion to voluntarily dismiss the petition for
review. In the motion, Midwest asserts that the matters for which the petition was filed have
been fully compromised and settled. The motion is granted. The Board hereby dismisses the
    petition, and closes the docket.
    IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on October 20, 2005, by a vote of 5-0.
    Dorothy M. Gunn, Clerk
    Illinois Pollution Control Board
