HEARING OFFICER ORDER

On June 22, 2005, in response to an inquiry from the hearing officer, petitioner reported

that it is still waiting for respondent to send written confirmation of the settlement agreement.

Once petitioner receives confirmation, it will file a motion to dismiss.

The parties are directed to participate in a telephone status conference with the hearing

officer at 2:00 p.m. on July 19, 2005. The status call shall be initiated by the petitioner.

Petitioner filed an open waiver of the statutory decision deadline in this matter.
