ORDER OF THE BOARD (by A.S. Moore):
On December 15, 2006, petitioner U.S. Minerals, LLC (U.S. Minerals) filed a motion for
voluntary withdrawal of its petition for review of certain terms and conditions of an air permit
(Mot.). U.S. Minerals states that settlement negotiations have succeeded and that the Illinois
Environmental Protections Agency “recently issued a revised Lifetime Operating Permit for
Petitioner’s Coffeen, Illinois facility that resolves the issues raised in these proceedings.” Mot.
at 1-2. U.S. Minerals further states that it “has no reason to maintain the instant action” and that
terminating the proceedings “would promote the interests of judicial economy.” Mot. at 2. The
Board grants U.S. Minerals’ motion, dismisses the appeal, and closes the docket.
IT IS SO ORDERED.
