    ORDER OF THE BOARD (by J.P. Novak):
    On January 13, 2005, the parties timely filed a joint notice to extend the 35-day period
    within which Red Rooster Corporation may appeal a December 30, 2004 determination of the
    Illinois Environmental Protection Agency (Agency).

    Adm. Code 105.402, 105.406. The Agency denied petitioner’s request for reimbursement of
    certain costs of corrective action from the Underground Storage Tank Fund for Red Rooster
    Corporation’s leaking underground petroleum storage tank facility located at 4805 North War
    Memorial Drive, Peoria, Peoria County.
    The Board extends the appeal period until May 9, 2005, as the parties request.

    appeal on or before that date, the Board will dismiss this case and close the docket.
