SECOND WAIVER OF DEADLINE FOR DECISION
NOW COMES Petitioner, RED ROOSTER CORPORATION, by its undersigned
attorneys, and pursuant to this Board’s procedural rule 101.308(c)(1),

Sec. 101.308(c)(1), hereby additionally waives its right to a decision within 120 days
from the date offiling ofthe Petition for Review in this case, as provided in Section
40.1(a) of the Illinois Environmental Protection Act,

ILCS 5/40.1(a), and extends the
deadline for final Board action for an additional one hundred and eighty (180) days from
the current decision deadline, October 6, 2005 to April 4, 2006.
