HEARING OFFICER ORDER

On August 18, 2005, petitioner contacted the hearing officer to request cancellation of the

hearing in light of the parties’ settlement agreement. The request is granted, and the hearing set

for August 24, 2005 is cancelled.

The parties are directed to participate in a telephone status conference with the hearing

officer at 11:00 a.m. on September 1, 2005. The status conference shall be initiated by the

petitioner.

Petitioner filed an open waiver of the decision deadline in this case.
