HEARING OFFICER ORDER
On January 18, 2005, the parties contacted the hearing officer to request cancellation of
the hearing set for January 19, 2005. Neither party was ready to proceed to hearing, and
petitioner believes that additional discovery may be needed before a hearing is reset. The
hearing officer agreed to cancel the hearing provided that petitioner submit a waiver of the
statutory decision deadline. The hearing officer received a copy of the waiver by facsimile, and
petitioner’s attorney stated that he mailed the original to the Clerk’s office today.
The parties are directed to participate in a telephone status conference with the hearing
officer at 2:30 p.m. on February 1, 2005. The status conference shall be initiated by the
petitioner.
Upon the Clerk’s receipt of the waiver, the decision deadline will be June 16, 2005.
