HEARING OFFICER ORDER
On September 15, 2005, all parties participated in a telephonic status conference with the
hearing officer. The respondent represented that it has voluntarily ceased operation of the
chillers from 10 p.m. to 7:00 a.m. The respondent further represented that, and by agreement of
the complainants, that it will order and install different size fans for the chiller in an attempt to
resolve the above-captioned matter. It was suggested that ordering and installation may take up
to 8 weeks, perhaps more. The respondent represented that after installation, further tests need to
be run for any possible adverse affects that the low sound fan option may have.
The parties are directed to file a written status report on November 10, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on November 17, 2005, at 11:00 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
