HEARING OFFICER ORDER
On September 22, 2005, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that a draft stipulation and proposal for settlement
(stipulation) is being discussed and circulated for review. Specifically, language for a
supplemental environmental project is being discussed. It was agreed that respondent’s answer
is now due to be filed on or before December 2, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on November 10, 2005, at 9:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing. If, however, a stipulation is filed
prior to the next status conference, the conference will be canceled without further order.
