HEARING OFFICER ORDER
On June 15, 2006, all parties participated in a telephonic status conference with
the hearing officer. The petitioner represented that the related matter was recently argued
in a state appellate court and is hopeful that a decision will be forthcoming. The decision
will affect the course in the above-captioned matter. The petitioner represented that it
will file a 90-day waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on September 14, 2006, at 9:15 a.m. The
telephonic status conference must be initiated by the petitioner, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties
must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing. If, however, a motion to dismiss is filed prior to the next status conference,
IT IS SO ORDERED.
