JURISDICTION
This Administrative Citation is issued pursuant to the authority vested in the Illinois
Environmental Protection Agency by Section 31.1 of the Illinois Environmental Protection Act (“Act”),
415 ILCS 5/31.1 (2000), and delegated to the County of Montgomery pursuant to Section 4(r) of
the Act, 415 ILCS 5/4(r) (2000),
FACTS
1.
That Michael Schwab is the present owner and/or operator of a facility located at part
of the Southwest Quarter (SWV4) of the Northwest Quarter (NW), Section Three (3), Township
Eight (8) North, Range Five (5) West, in Montgomery County, Illinois. The property is commonly
known to Montgomery County as S. Litchfleld Twp./Schwab, Michael
2.
That said facility is an open dump operating without an Illinois Environmental
Protection Agency Operating Permit and is designated with Site Code No. 1358155017.
3.
That Respondent has owned and/or operated said facility at all times pertinent
hereto.
4.
That on August 2, 2004, Bill Gonet of the Montgomery County Coordinated Services’
office inspected the above-described facility. A copy of his inspection report setting forth the results
of said inspection is attached hereto and made a part hereof.

VIOLATIONS
Based upon direct observations made by Bill Gonetduring the course of his August 2, 2004
inspection of the above-named facility, Montgomery County has determined that Respondent has
violated the Act as follows:
(1)
That Respondent caused or allowed the open dumping of waste in a manner
resulting in litter, a violation of Section 21(p)(1) of the Act, 415 ILCS 5/21(p)(1)
(2000).
(2)
That Respondent caused or allowed the open dumping of waste in a manner
resulting in deposition of general construction or demolition debris or clean
construction or demolition debris, a violation of Section 21(p)(7) of the Act, 415 ILCS
5/21 (p)(7) (2000).
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2000), Respondent is
subject to a civil penalty of One Thousand Five Hundred Dollars ($1,500.00) for each of the
violations identified above, for a total of Three Thousand Dollars ($3~000.00).If Respondent elects
not to petition the Illinois Pollution Control Board,the statutory civil penalty specified above shall be
due and payable no later October 15, 2004, unless otherwise provided by order of the Illinois
Pollution Control Board.
If Respondent elects to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31 .1 of the Act, 415 ILCS 5/31.1(2000), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatoryhearing,
Respondent shall be assessed the associated hearing costs incurred by Montgomery County and

the Illinois Pollution Control Board. Those hearing costs shall be assessed in addition to the One
Thousand Five Hundred Dollar ($1,500.00) statutory civil penalty for each violation.
Pursuant to Section 31.1 (d)(1) of the Act, 415 ILCS 5/31 .1 (d)(1) (2000), if Respondent fails
to petition or elects not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative Citation and findings of violation as
alleged herein, and shall impose the statutory civil penalty specified above.
When payment is made, Respondent’s check shall be made payable to the Montgomery
County Coordinated Services office and mailed to the attention of Christine Daniels,
County
Coordinator, at P.O. Box 122, Hillsboro, Illinois
62049. Along with payment, Respondent shall
complete and return the enclosed Remittance Form to ensure proper documentation of payment.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order of
the Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against the Respondent from the date payment is due up to and including the date that payment is
received. The State’s Attorney of Montgomery County may be requested to initiate proceedings
against Respondent in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued.

PROCEDURE FOR CONTESTING THIS
ADMINISTRATIVE CITATION
Respondent has the right to contest this Administrative Citation pursuant to and in
accordance with Section 31.1 of the Act, 415 ILCS 5/31/1 (2000). If Respondent elects to contest.
this Administrative Citation, then Respondent shall file a signed Petition for Review, including a
Notice of Filing, Certificate of Service, and Notice of Appearance, with the Cleric of the Illinois
Pollution Control Board, State of Illinois Center, 100 West Randolph, Suite 11-500, Chicago, Illinois
60601. A copy of said Petition for Review shall be filed with the State’s Attorney of Montgomery
County at the Montgomery County Courthouse, 120 North Main, Room 212, Hillsboro, Illinois 62049.
Section 31.1 of the Act provides that any Petition for Review shall be filed within thirty-five (35) days
of the date of service of this Administrative Citation or the Illinois Pollution Control Board shall enter
a default judgment against the Respondent.

Affiant, Bill Gonet, being first duly sworn, Voluntarily deposes and states as follows:
1. Affiant is a field inspector employed by the Montgomery County Coordinated
Services’ office and has been so employed at all times pertinent hereto.
2. On August 2, 2004 between 10:20 am. and 10:50 a.m., Affiant conducted an
inspection of the site in Montgomery County, Illinois, known as S. Litchfield Twp./Schwab,
Michael, Site Code No. 1358155017.
3. Affiant inspected said S. Litchfield Twp./Schwab, Michael site by an on-site
inspection which included photographing the site.
4. As a result of the activities referred to in Paragraph 3 above, Affiant completed
the Inspection Report form attached hereto and made a part hereof, which, to the best of

A re-inspection of the S. Litchfield Twp./Schwab, Michael site was conducted on August
2, 2004. The site was previously inspected on July 22, 2003 and re-inspected on
November 18, 2003, January 21, 2004, and June 14, 2004. During the June 14, 2004
inspection the following violations ofthe Environmental Protection Act were observed:
2 1(a) cause or allow open dumping and 21Q) cause or allow the open dumping of any
waste in a mannerwhich results in any ofthe following occurrences at the dump site: (1)
litter, (7) deposition ofgeneral construction or demolition debris; or clean construction or
demolition debris.
The site is located on the north side ofOld Quarry Trail positioned betweenDana Brake
Parts Inc. and the Litchfield Country Club in the SWV4 of the NW1/4 of Section 3 in South
Litchfield Township. The property is owned by Michael Schwab per the Last Will of
Herman F. Hagerdorn. The mailing address forMichael Schwab is

On July 24, 2003 an Administrative Citation Warning Notice (ACWN) and a copy ofthe
July 22, 2003 inspection report were sent to Mr. Michael Schwab by certified mail. Mr.
Schwab responded to the ACWN in a letter dated August 12, 2003.
On November 19, 2003 an extension was granted until January 20, 2004 on the condition
that all ofthe remaining waste and the site must be removed by the extended compliance
deadline.
On February 23, 2004 an extension to the compliance deadline and a copy of the January
21, 2004 inspection were hand delivered to Mr. Louie Schwab, father ofMr. Michael
Schwab. In this extension it stated that if the site was not in complete compliance by
March 23, 2004 then further enforcement action would be taken through the Montgomery
County State’s Attorney’s Office.
On June
15,
2004 a letter from the Montgomery County State’s Attorney’s Office and a
copy ofthe June 14, 2004 inspection report were sent to Mr. Michael Schwab by certified
mail. This letter basically stated that if the site was not in complete compliance by July

30, 2004, then Montgomery County Coordinated Services would pursue further
enforcement action through the Montgomery County State’s Attorney’s Office. The letter
and inspection report were returned and marked as unclaimed. On July 23, 2004 the
Montgomery County State’s Attorney’s Office re-sent copies ofthe letter and inspection
report to Mr. Michael Schwab by U.S. Mail, regular delivery. As ofAugust 4, 2004 the
letter and inspection report have not been returned.
I arrived at the site at 10:20 a.m. The temperature was about 82°Fwith clear skies. There
a light wind coming from the southwest and the soil condition was dry. No one was met
at the site during the inspection. This inspection was conducted in order to verify
compliance with the June
15,
2004 letter sent by the Montgomery County State’s
Attorney’s Office.
As in the previous inspection reports, the site has been divided into two separate areas
and will be referred to in this inspection report as
Area-A- and Area-B-
(see attached
area sketch).
Area —A-
Area —A- is located in the west half ofthe property and is bordered by Dana Brake Parts
Inc. Observed in this area during the previous inspection were various types of waste
consisting ofscrap metal, plastic buckets, plastic 1 qt oil cans, bed springs, dimensional
lumber, tarps, window frames, open top trailers filled with waste, two abandoned
vehicles, and other various types ofdebris.
Shown in photos 001 through 010 is that all ofthe previously observed wastes were still
present. It appeared that no attempt had been made to properly dispose of any ofthe
waste from Area —A-. The site was in about the same condition as it was during the
previous inspection (see Area —A- site sketch). The only noticeable difference was that
some ofthe waste items had been moved to a different location on the property (photo
010). The amount ofwaste remaining in Area —A- was estimated at about lSyds3.

is located in the east half ofthe property and is bordered by the Litchfield
Country Club. Observed in this areaduring the previous inspection were scrap metal, tin,
dimensional lumber, plastic

gal buckets, windows, a

gal drum containing a small
amount ofliquid, and two abandoned vehicles.
Shown in photos 011 through 018 is that all ofthe previously observed wastes were still
present. It appeared that no attempt had been made to properly dispose of any ofthe
remaining waste from Area —B-. It was noticed that one ofthe abandoned vehicles had
been moved approximately 20 from where it was observed during the previous
inspection. It is not known if this vehicle was able to move under its own power or if it
was towed. There were no noticeable improvements made to this area (see Area —B- site
sketch). The amount ofwaste remaining in Area —B- was estimated at 1 5yds3.

Please
note:
Due to that tall vegetation at the time of the inspection, photographic
documentation ofall the wastes in Areas —A- & -B- was difficult to obtain; however all
ofthese waste were verified by walking through the weeds and standing on the waste.
I left the site at 10:50 a.m.
See attached Open Dump Checklist for apparent violations.
Since Mr. Schwab has made no contact with Montgomery County Coordinated Services
concerning the apparent violations at site, it is not known if the vehicles observed during
the inspection were operable. Therefore, the four vehicles observed during the inspection
were considered to be abandoned.
