AMENDED HEARING OFFICER ORDER
On September 21, 2006, at 10:30 a.m., all parties participated in a telephonic status
conference with the hearing officer. The complainant represented that a penalty demand has
been forwarded to the respondent. The respondent represented that it is in the process of
gathering and forwarding ability to pay documents, including tax returns. To that end, it was
agreed that the respondent’s answer is now due to be filed on or before December 8, 2006.
At 4:17 p.m., on September 21, 2006, and after the September 21, 2006, hearing officer
order had been mailed, counsel for the respondent electronically mailed the hearing officer
requesting that the order include that even though the respondent is forwarding the ability to pay
documents to the complainant, it makes no admission of liability. Counsel for the respondent
represented that the complainant has no objection to this request.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on November 16, 2006, at 10:00 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
