On January 13, 2003, the Environmental Law and Policy Center ofthe Midwest, Illinois
Chapter of the Sierra Club, Prairie Rivers Network, and 225 citizen petitioners (collectively “the
proponents”) filed a proposal for rulemaking. They propose to amend the Board’s regulations at
35 Iii. Adm. Code 309 for the issuance ofpermits by the Illinois Environmental Protection
Agency (Agency) under the National Pollutant Discharge Elimination System (NPDES). On
January 23, 2003, the Board accepted this matter for hearing.
The Board will hold at least two hearings in this matter. Both hearings will be conducted
to allow the proponents and all other interested parties the opportunity to present testimony on
the proposedrules. The order ofthe first hearing will be:
1.
Opening statements;
2.
Testimony by the proponents; and
3.
Questions of the proponents;
The order ofthe second hearing will be determined at the beginning ofthe second hearing.
The “Notice List” is the list of interested persons who wish to receive only the Board’s
opinions and orders and hearing officer orders in this proceeding. The “Service List” is persons
who wish to participate in the proceeding and receive all prefiled testimony and to be participants
ofrecord. To be placed on either the “Notice List” or the “Service List” contact the hearing
officer at the address or phone number below.
Persons who plan to testify must prefile their testimony. Proponents have prefiled their
testimony with the Board as a part ofthe proposal. That testimony will be available either on the
Board’s web page at www.ipcb.state.il.us or by contacting the hearing officer. The prefiling
deadline for the second hearing will be established at the first hearing.
