On January 13, 2003, the Environmental Law and Policy Center of the Midwest, Illinois

Chapter ofthe Sierra Club, Prairie Rivers Network, and 225 citizen petitioners filed a proposal

for rulemaking. The proposal amended the Board’s regulations at 35 Ill. Adm. Code 309 for the

issuance ofpermits by the Illinois Environmental Protection Agency under the National Pollutant

Discharge Elimination System (NPDES). On January 23, 2003, the Board accepted this matter

for hearing. On September 4, 2003, the Board proceeded to first notice with a proposed rule and

directed that a hearing on the proposed rule be held.
