HEARING OFFICER ORDER

On December 15, 2005, the Board granted complainant’s motion to stay this proceeding

until such time as the Board orders otherwise. On June 25, 2007, the parties reported some

progress in the settlement discussions that are part of a joint federal and state global initiative

against respondent. However, the parties report that settlement is still a long way off, thus

complainant does not currently plan to request that the stay be lifted.

The parties are directed to participate in a telephone status conference with the hearing

officer at 9:00 a.m. on December 17, 2007. The status conference shall be initiated by the

complainant.
