    ORDER OF THE BOARD (by E.Z. Kezelis):
    On October 8, 1999, the Village of White City (White City) filed a petition for a variance from the Board’s
    public water supply regulations regarding restricted status listings of public water supply facilities. Specifically,
    White City seeks a variance from those portions of 35 Ill. Adm. Code 602.106(a), that relate to the maximum
    contaminant level (MCL) for total trihalomethanes (TTHM).
    Pursuant to Section 104.121 of the Board’s procedural rules (35 Ill. Adm. Code 104.121), variance petitions
    must contain certain information necessary to enable the Board to rule on the petition for variance. While the
    current petition contains much of the required information, it does not sufficiently address White City’s plan to
    achieve full compliance with the MCL for TTHM in the future. Moreover, White City alleges that its inability to
    achieve the MCL for TTHM is due to an inability by its water supplier, the City of Mount Olive, to provide
    compliant water. White City states that efforts are currently being undertaken by the City of Mount Olive to
    achieve compliance with the MCL, but those efforts are not substantiated in sufficient detail and the City of Mount
    Olive is not a party to this proceeding.
    The Board directs White City to file, within 30 days of the date of this order, an amended petition that
    addresses the deficiencies set forth above. Specifically, the amended petition should contain a substantive
    discussion of White City’s plans to achieve compliance with the MCL for TTHM. White City is also directed to
    address whether the City of Mount Olive should be joined as a co-petitioner in this proceeding.
