HEARING OFFICER ORDER
On May 24, 2007, the parties were scheduled to participate in a telephone status
conference with the hearing officer. Neither party appeared. The hearing officer left a
message for petitioner’s attorney, but the call was not returned. According to respondent,
this appeal has been resolved by subsequent permits. As petitioner has participated in
only one of the last five status conferences, and has not returned the hearing officer’s
calls, the hearing officer assumes that petitioner has lost interest in pursuing this appeal.
If petitioner does not file a status report by June 30, 2007, the hearing officer will ask the
Board to dispose of this appeal on petitioner’s behalf.
Petitioner filed an open waiver of the decision deadline in this case.
