HEARING OFFICER ORDER
On April 15, 2009, petitioner participated in a telephone status conference with the
hearing officer. Petitioner is working with respondent’s technical division to get the appropriate
permits in accordance with the negotiated agreement. Petitioner hopes that the permits will be
ready in 30 to 60 days.
The parties are directed to participate in a telephone status conference with the hearing
officer at 11:00 a.m. on May 20, 2009. The status conference shall be initiated by the petitioner.
There is an open waiver of the statutory decision deadline in this matter.
