ORDER OF THE BOARD (by M. McFawn):
On May 21, 1997, the Illinois Environmental Protection Agency (Agency) filed a
motion requesting that the Board waive two filing requirements. First, the Agency requests
that the Board waive its requirement that the Agency submit ten copies of the respondent’s
Administrative Record to the Board as required by 35 Ill. Adm. Code 103.123(b), and instead
be allowed to file four copies. That request is granted; the Agency need file only four copies
of the Administrative Record in this case.
Second, the Agency requests that the Board waive its requirement that the Agency
submit four copies of documents to be incorporated by reference from Frederick Cooper v.
IEPA, PCB 96-158, as required by 35 Ill. Adm. Code 101.106. That request is denied
because the Board no longer has the copies necessary to distribute these documents to each of
its offices. The Agency is directed to file the four copies of the documents it seeks to
incorporate by reference in accordance with Section 101.106 of the Board’s procedural rules.
The filings required pursuant to this order must be filed by the Agency within 30 days
of the date of this order, or as otherwise ordered by the hearing officer assigned to this case.
    IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, hereby certify that
the above order was adopted on the 5th day of June, 1997, by a vote of 7-0.
    Dorothy M. Gunn, Clerk
    Illinois Pollution Control Board
