HEARING OFFICER ORDER
On April 21, 2005, all parties participated in a telephonic status conference with the
hearing officer. The petitioner informed the hearing officer that it is preparing a corrective
action report and submit it to the respondent for review in anticipation of a no further
remediation letter. It appears that one more boring sample needs to be completed before the
report is forwarded to the respondent. The hearing officer is concerned with the length of time,
since September 16, 2004, that it has taken the petitioner to complete the sampling. The hearing
officer directs the petitioner to complete the boring prior to the next status conference.
The parties are directed to participate in a telephonic status conference with the hearing
officer on June 23, 2005, at 9:15 a.m. The status conference must be initiated by the petitioner,
but each party is nonetheless responsible for its own appearance. At the status conference, the
parties must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing
