HEARING OFFICER ORDER
On October 2, 2008, all parties participated in a telephonic status conference with the
hearing officer. The hearing officer confirmed that the hearing in the above-captioned matter has
been scheduled for December 10, 11, 2008. The time and location will be noted in the notice of
hearing. The complainant represented that it has forwarded the stipulation of facts document to
the respondent.
Depositions of the benefit analysis witnesses had to be delayed due to a medical
situation with the complainant’s witness. The parties are attempting to reschedule the respective
depositions. The parties were informed that all pre-hearing motions, including motions in
limine
, must be filed on or before November 10, 2008. Responses due to be filed on or before
November 14, 2008. The parties witness list and exhibit list are to be filed on or before
November 21, 2008.
The parties are directed to participate in a telephonic status call with the hearing officer on
October30, 2008, at 11:45 a.m. The status conference must be initiated by the complainant, but
each party is nonetheless responsible for its own appearance. At the status conference, the
parties must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing.
