HEARING OFFICER ORDER
On March 5, 2009, all parties participated in a telephonic status conference with
the hearing officer. The parties represented that it appears a settlement has been
achieved, however, discussions continue. If a settlement is achieved prior to the next
status conference, the petitioner represented that it will file a motion to voluntarily
dismiss the above-captioned appeal. By agreement, the record is now due to be filed on
or before May 11, 2009. The petitioner represented that it will file an additional 60-day
waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic
status conference on April 14, 2009, at 1:00 p.m. The status conference must be initiated
by the petitioner, but each party is nonetheless responsible for its own appearance. At the
status conference, the parties must be prepared to discuss the status of the above-
captioned matter and their readiness for hearing. If, however, a motion to voluntarily
dismiss the above-captioned matter is filed before the next status conference, the
conference will be cancelled without further order.
