MOTION TO WITHDRAW
ADMINISTRATIVE CITATION
NOW COMES the Complainant, the Illinois Environmental Protection Agency (“Illinois
EPA”), by and through its attorney, Assistant Counsel Michelle M. Ryan, pursuant to 35 Ill. Adm.
Code 101.500, and respectfully states as follows:
(1)
On November 25, 2008, Illinois EPA issued an Administrative Citation to
Respondent GILBERT AND MARY CODGILL ESTATE, c/o William Codgill, Executor,
(“Respondent”), based on an inspection conducted on October 17, 2008.
(2)
On December 18, 2008, Illinois EPA filed a return of service, indicating that any
Petition for Review in this case is due on January 14, 2009.
(4)
Facts and circumstances discovered since the filing of the Administrative Citation
indicate that it is appropriate to withdraw this Administrative Citation at this time.
