HEARING OFFICER ORDER
On February 19, 2009, the petitioner informed the hearing officer that the parties
continue with discussions and are close to resolving permit issues challenged in the
above-captioned appeal. At present, the petitioner is reviewing a draft permit forwarded
to it by the respondent. The respondent was unable to appear due to a scheduling conflict.
The petitioner represented that it will file an additional 90-day waiver of the statutory
decision deadline.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on May 21, 2009, at10:30 a.m. The telephonic
status conference must be initiated by the petitioner, but each party is nonetheless
responsible for its own appearance. At the status conference, the parties must be prepared
to discuss the status of the above-captioned matter and their readiness for hearing.
