ORDER OF THE BOARD (by G.L. Blankenship):
On February 27, 2009, petitioner Joyce Farms Recycling, Inc. (Joyce Farms) filed a
Motion for Voluntary Dismissal (Mot.). Joyce Farms states that, on September 1, 2006, it “filed
a Petition for Review of Permit Number 2000-138-DE/OP which was issued on July 27, 2006” to
its existing landscape waste compost facility. Mot. at 1. The motion states that, following
settlement negotiations between the parties, the Illinois Environmental Protection Agency on
February 25, 2009, issued a corrected revised permit.
Id
. The motion further states that, because
the parties have resolved all of the contested issues, Joyce Farms requests that the Board grant
the motion and dismiss the appeal.
Id
. The Board grants the motion for voluntary dismissal,
dismisses the appeal, and closes the docket.
IT IS SO ORDERED.
