HEARING OFFICER ORDER
On December 1, 2004, the parties informed the hearing officer that they have a
scheduling conflict for the telephonic status conference set for December 2, 2004. They also
represented that they continue to await the decision of the Illinois Environmental Protection
Agency regarding a penalty calculation. It is noted that the Agency has been attempting to
calculate the penalty calculation since at least December 16, 2003.
The December 2, 2004, telephonic status conference is hereby continued to the date and
time noted below.
The parties are directed to participate in a telephonic status call with the hearing officer on
February 3, 2005, at 10:00 a.m. The status conference must be initiated by the complainant, but
each party is nonetheless responsible for its own appearance. At the status conference, the
parties must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing.
