ORDER OF THE BOARD (by T.E. Johnson):
On April 3, 2009, the Illinois Department of Transportation (IDOT) filed a motion to
voluntarily withdraw its adjusted standard petition (Mot.), attaching a status report. IDOT had
sought an adjusted standard from the Board’s general use water quality standards for sulfate and
total dissolved solids (TDS) in effect on July 27, 2007, the date on which IDOT filed the petition
(35 Ill. Adm. Code 302.208(g)). The petition concerns discharge from IDOT’s District 8
Bowman Avenue Pump Station in East St. Louis, St. Clair County. At IDOT’s request, this
proceeding was stayed by Board orders of December 20, 2007, and December 4, 2008.
In IDOT’s motion for voluntary withdrawal, IDOT states that in March 2009, the United
States Environmental Protection Agency (USEPA) issued a letter to the Illinois Environmental
Protection Agency approving Illinois’ revised water quality standards for sulfate and TDS. Mot.

standard petition “is no longer necessary” because “[t]he revised criteria for sulfate and TDS
adopted by the Board

and later approved by the USEPA satisfies [IDOT’s] Petition for Adjusted
Standard for sulfate and TDS.” Mot. at 1. The Board terminates the stay of this adjusted
standard proceeding, grants IDOT’s motion, dismisses the case, and closes the docket.
